Pre-Trial Deferral
The Jasper County Prosecutor's Office offers a Pre-Trial Deferral to certain drivers who qualify. The purpose of the deferral program is to keep a moving violation from appearing on your driving record. In order to qualify, you must not have three or more moving violations on your driving record in the past three years; you must not have been convicted of Reckless Driving, Driving While Suspended or Driving While Intoxicated within the past 10 years; you can not hold a Commercial Driver's License (CDL); and you must not currently be enrolled in a deferral program in another county or have been enrolled in this or a similar program within the past two years.
For a moving violation or speeding violation up to 20 miles per hour over the posted speed limit, the cost of the deferral program is $192.50 and the deferral period is for six months. A speeding violation in excess of 21 mph to 25 mph over the posted speed limit may be allowed to enter into a deferral agreement for one year, with a cost of $252.50. Speeding violations in excess of 26 miles per hour are not eligible for deferral.
During the deferral period, you can not receive another ticket or be charged with any criminal offense. If you do violate the terms of the deferral program, you will be removed from the program and forfeit the fees paid for the program. You would then be responsible for paying the cost of the original ticket, along with any fines and/or costs associated with your new violation.
